CAREER
Katya Tua is a Partner at Mamo TCV Advocates. She heads the
Investment Services department of the firm. She advises primarily
international clients in the incorporation and licensing of all types of
collective investment schemes including UCITS, alternative investment funds
(“AIFs”) and professional investor funds (“PIFs”) as well as on regulatory
issues dealing with MiFID II. Katya is a member of the Chamber of Advocates and the Institute of
Financial Services Practitioners. Moreover, she is
continuously recognised in major legal guides such as the Legal500 and
Chambers.
EDUCATION AND PROFESSIONAL QUALIFICATIONS
- Graduated in 2001 from the University of Malta with a Doctorate of Laws obtained after submitting a Doctoral thesis entitled ‘Legal consequences of the use of the Internet as a medium for financial services’.
- Graduated with a Master of Laws in 2002 from University College London, London, UK after pursuing the following courses namely, Company Law, Advanced Equity and Trusts Law, Law of International Finance and Internet Law.
- Admitted to the Maltese Bar in 2003.
- Joined the law firm Grech Vella Tortell & Hyzler- Advocates as an associate in the same year.
- Joined Simon Tortell and Associates as a founding partner in 2009 and in 2016 became a partner at Mamo TCV Advocates following a merger.
- Regularly publishes articles on various topics within the financial services and regulatory field, contributing to industry expertise and staying abreast of industry developments.
EXPERIENCE (INVESTMENT FUNDS)
- Maltese counsel for the setting up and licensing the first UCITS III platform in Malta.
- Maltese counsel to the first Bermuda based professional investor fund that re-domiciled to Malta.
- Counsel to the first professional investor fund incorporated and licensed in Malta that was structured as a limited partnership.
- Counsel to the first fully operational Recognised Incorporated Cell structure set up in Malta.
OTHER EXPERIENCE
- Handles various change in control briefs of regulated entities in Malta;
- Gives legal advice in relation to anti-money laundering issues;
- Offers strategic guidance to investment service providers classified under the Markets in Crypto-Assets (MiCA) Regulation.
